Contract for Library Service for Clayton County

This contract is made and entered into this 24th day of May, 1982, by and between the Clayton County Board of Supervisors on behalf of Clayton County, Iowa (County), ant the Board of Trustees of the public libraries in the following cities: Edgewood, Elkader, Farmersburg, Guttenberg, Garnavillo, Littleport, McGregor, Monona, Strawberry Point, and Volga (Libraries), and the parties agree as follows:

  1. Clayton County, Iowa, does not have a County Library as provided in Chapter 358B of the Code of Iowa.
  2. All of the cities named above have libraries which are supported by levies upon the property in their respective corporation.
  3. It is mutually desired by all parties hereto that residents of the unincorporated areas of Clayton County receive library service from any library mentioned above on an equal basis, whether such patrons and residents live within the corporate limits of said cities, and this contract is made in accordance with the provisions of chapter 303A, 303B, 358B and 28E of the 1981 Code of Iowa.
  4. Each and all of the above Libraries agree to loan library materials to all residents of Clayton County, Iowa, upon the same terms and conditions as the Libraries loan materials to the residents of the cities in which said Libraries are located.
  5. The support received by each library through taxation from their respective corporations will not be decreased as a result of the funds received pursuant to this contract.
  6. The funds received from Clayton County according to this agreement shall be used for the purchase of materials, equipment and services. These funds shall not be used for capital improvements.
  7. Clayton County agrees to levy a tax not to exceed 20¼¢ per One Thousand Dollars ($1,000.00) of taxable valuation on all of the taxable property of the County outside the cities and towns and from the levy, set up a fund to be known as the Library Fund. Said levy shall be effective for the fiscal year beginning July 1, 1983.
  8. The Library Fund created by this contract shall be divided into twenty-two (22) equal parts to be distributed in the following manner by the County Auditor of Clayton County, Iowa:
    9. One part thereof to be paid over to the Volga Public Library;
    One part thereof to be paid over to the Littleport Community Library;
    One part thereof to be paid over to the Farmersburg Public Library;
    One part thereof to be paid over to the Edgewood Public Library;
    Three parts thereof to be paid over to the Elkader Public Library;
    Three parts thereof to be paid over to the Guttenberg Public Library;
    Three parts thereof to be paid over to the McGregor Public Library;
    Three parts thereof to be paid over to the Garnavillo Public Library;
    Three parts thereof to be paid over to the Monona Public Library;
    Three parts thereof to be paid over to the Strawberry Point Public Library;
    The Edgewood portion herein is based on its location in Clayton County.
  9. This agreement shall remain in effect for a period of one (1) year beginning July 1, 1983 to June 30, 1984 and shall run fro year to year thereafter unless terminated by consent of all of the parties hereto.
  10. It is understood and agreed that the parties shall review this contract prior to January 1 of each year at which time the amount of the levy set out in Paragraph 7 above may be renegotiated. Negotiated changes shall be attached as amendments and this contract shall continue from year to year as long as the parties hereto comply with the provisions of this agreement.
  11. This agreement terminates a prior agreement entered into by the parties on February 4, 1963 and amended on July 9, 1971 between Clayton County, Iowa, and all of the city libraries which are parties hereto. It is specifically agreed by the parties hereto that the effective date of this contract shall be considered to be July 1, 1983. The parties hereto waive any and all rights with they may have under the prior agreement set out above and consent to the replacement of the former contract with this contract effective July 1, 1983.

    12. IN WITNESS WHEREOF, the parties have executed this agreement on the dates set out below.
