CONTRACT FOR LIBRARY SERVICE FOR HOWARD COUNTY
This contract is made and entered into this 10th day of May, 1999, by and between the
Howard County Board of Supervisors on behalf of Howard County, Iowa, herein after called
the county, and the Board of Trustees of the public libraries in the cities of Cresco, Elma, Lime
Springs and Riceville, Iowa, herein after called the libraries. The parties do hereby agree,
acknowledge and contract as follows that:
- Howard County, Iowa, does not have a county library as provided in
Chapter 358B of the Code of Iowa.
- All of the cities named above have libraries which are supported by levies
upon the property in their respective corporation.
- It is mutually desired by all parties hereto that residents of the unincorporated
areas of Howard County receive library service from any library mentioned
above upon an equal basis whether such patrons and residents live within
the corporate limits of said cities, and that this contract is made in
accordance with the provisions of chapter 303A, 303B, 358B and 28E of
the Code of Iowa.
- Each and all of the above libraries agree to loan library materials to all
residents of the unincorporated areas of Howard County, Iowa upon the
same terms and conditions as the libraries loan materials to the residents of
the cities in which said libraries are located.
- The libraries will not decrease the amount of support received through
taxation within their respective corporation due to the receiving of these
monies.
- Funds received from the county according to this agreement shall be used
for the purchase of materials, equipment and services. These funds shall
not be used for capital improvements.
- The County shall appropriate no less than $26,600.00 for FY99/2000 in
accordance with sections 303B.9 and 358. 18 of the Code of Iowa.
- Such funds shall be divided on the basis of the following formula as agreed
to by the aforementioned libraries, provided that no library shall receive
from the County funds greater than the amount of its local financial
support.

| *This agreement was reached and voted on at a special meeting of the Howard County
Library Association November 20, 1995 in Cresco, Iowa. The agreed-upon change will
become effective July 1, 1996. |
FORMULA FOR DIVISION OF FUNDS
40% - Equally
24% - determined by hours open
24% - determined by amount spent on books
12% - determined by amount spent on periodicals and audiovisual materials.

- Distribution of the funds pursuant to paragraph 8 herein shall be made as
follows: one-half (1/2) on the fifteenth of October of each fiscal year, and
one-half (1/2) on the fifteenth of April of each fiscal year.
- Any aforementioned library or libraries may waive the right to that fiscal
year's allocation of tax money. Said notice of waiver is to be filed in the
County Auditor's office. Any funds waived by a library or libraries shall be
redistributed in the same fiscal year to the remaining libraries according to
the agreed distribution formula.
- This agreement shall remain in effect for a period of one (1) year
beginning July 1, 1999 and ending June 30, 2000.
- Each city library shall submit annually to the County the following
documents:
- A completed copy of the State Library's Public Library
survey for the previous fiscal year.
- A copy of the library's current and projected
expenditures.
- Statistics reflecting the use of the library by rural
Howard County patrons.
- The County may withhold any library's funds for failure to comply with
any provision of this contract. The withheld funds will be redistributed
among the remaining libraries according to paragraph 8 herein.
- The County shall be authorized to appoint one rural resident as a member
of the Board of Trustees of each library, at such time and for such term as
is provided by the governing instrument of each library.
- This terminates a prior agreement entered into on May 18, 1998 and
consent to the replacement of the former contract with this contract.
